Step 1 Draft the By-Law
Using DIY By-Laws you can easily add your lot details, select what areas you are renovating and attach the relevant plans to create a by-law and motion instantly! Your by-law will describe any impact there may be to common property (for example, waterproofing in bathroom, moving plumbing or external walls).
Step 4 The General Meeting
Your motion will be discussed at the AGM and details will be reviewed. Then a vote will be taken by all owners attending (and via proxy) the AGM on your motion. This will be specially resolved and you will get approval or could be asked to provide changes or more detail. A majority vote will get this approved.

If a lot owner starts any non-cosmetic work to common property before the appropriate approval is obtained (see FAQ 1), they will be considered ‘unauthorised works’ and technically comprise damage to the common property that the owners corporation has a strict legislative duty to rectify.
To satisfy their obligations, the owners corporation can apply to NCAT for orders requesting that the lot owner reinstate the common property or otherwise pay the owners corporation for the cost of rectifying the damage and any associated costs, such as insurance and legal costs.
The owners corporation can also seek interim orders from NCAT to stop a lot owner from carrying out unauthorised works to common property. Please see our article on interim orders here.
Additionally, an owners corporation may engage the local council to stop the carrying out of unauthorised works and/or have the works removed. In taking such steps, an owners corporation should be cautious of any possible consequences to the engagement – e.g. council’s investigations may lead to an expensive compliance order for the scheme, such as a fire safety upgrade order.
